The first step is to prepare and send the necessary documentation by email. This process is essential for us to formalize the reservation of the property and stop marketing it.

Requirements according to tenant profile:

▸ Individuals

  • Identification document (ID card, NIE or Passport).
  • The last two payslips.
  • Employment contract (if not permanent).
  • Recommended: references from the previous landlord (if they have rented before).

▸ Students

  • Identification document (ID card, NIE or Passport).
  • Enrollment or proof of registration in an official educational institution.
  • Permanent address in the home country.
  • In some cases, a guarantor or financial guarantor may be requested.

▸ Displaced multinational employee

  • Identification document (ID card, NIE or Passport).
  • Letter from the company specifying the position, salary, and working conditions.
  • Employment contract.
  • Last two payslips (if applicable).
  • Contact person in the company who can validate the information.

▸ Company as a tenant

  • Tax Identification Number (CIF) and corporate presentation or website.
  • Deed of incorporation of the company.
  • Powers of attorney of the person who will sign the contract.
  • Identification document of the attorney.
  • Last Corporate Tax Return.
  • Recent VAT declarations.
  • Last financial statement or annual accounts.

Once the economic conditions have been agreed upon by both parties, you can proceed with the formal reservation of the property. This process ensures that the property is taken off the market and visits with other interested parties are canceled.

Conditions for reserving a property

The conditions may vary depending on the tenant's profile, the documentation provided, and the type of property. These conditions are established by the owner, in coordination with Atipika, and are communicated clearly and in writing before formalizing any commitment.

Below are the most common conditions:

Legal deposit

  • A deposit equivalent to two months' rent is required, as established by the Urban Leases Law (LAU), to cover possible damages or contractual breaches.
  • This deposit cannot be used as payment for the last rental months.
  • The owner is required to deposit the deposit with the corresponding official entity (usually, the Urban Property Chamber of Catalonia).

Additional guarantees

Depending on the proven solvency, the owner may request an additional deposit or bank guarantee. This measure aims to reinforce the guarantee of contractual compliance, especially in high-value rentals or profiles with limited documentation (such as self-employed individuals or foreign companies).

Reservation process

To formalize the reservation, once the conditions have been validated, you must pay the corresponding amount for one month's rent. This amount can be paid:

  • At our offices (in cash or by card).
  • By bank transfer to the account designated by Atipika.

This monthly payment will be deducted from the total amount to be paid on the day of contract signing.

Once the reservation is formalized, we will provide you with a detailed document with the financial terms of the lease. On the day of the contract signing, you must pay the following amounts:

  • First month's rent in advance.
    If the signing takes place after the 5th day of the month, only the proportional part will be paid.
  • Agreed deposit at the time of the reservation, in accordance with current legislation.
  • Intermediation fees, which amount to 10% of the total annual rent, plus the current VAT (21%), depending on whether it is a temporary rental or a long-term rental. If it is a long-term rental, the commission must be paid to the owner.

Additionally, it will be necessary to provide a Spanish bank account number to set up direct debits for both the monthly rent and utilities (water, gas, electricity, etc.).

The lease agreement is signed directly between you and the property owner. Therefore, any queries, communications, or incidents during the rental period must be managed with the owner or the person designated by them in the contract, if Atipika does not handle the administration or property management, communication will be between Atipika and the property.

Is the property managed by Atipika?

If Atipika manages the property, you can directly contact our administration department to report any questions, breakdowns, or situations related to the property.

We will take care of:

  • Resolving incidents during the contract.
  • Carrying out administrative follow-up.
  • Managing the end of the lease.
  • Coordinating the return of the deposit, as stipulated.

With Atipika, not only do you rent securely, but you also have professional support throughout the duration of the contract.

In order to terminate a lease agreement, it is essential to communicate in writing your intention not to renew, respecting the notice period stipulated in the contract, which is usually one or two months, as agreed.

Steps for a correct termination of the contract:

  1. Formal communication
     Send a written notification or an email, respecting the established notice period to Atipika and the property.
  2. Signing of the contractual waiver
     On the day of key handover, the written waiver document will be signed, certifying the end of contractual obligations for both the tenant and the landlord.
  3. Key handover and property condition inspection
     It is essential to return the property in similar conditions to those at the beginning, after having carried out cleaning and maintenance.

Recommendations to facilitate your departure

  • Deposit:
    The law establishes a maximum period of 30 days from key handover for the return of the deposit. In Barcelona, the Property Chamber usually manages the refund within 7 to 15 days, once the request is received along with the contractual waiver document.

  • Bank guarantee:
    Once the waiver document is signed and if there are no pending damages, the guarantee becomes invalid. The landlord must return the original to the tenant, who will present it at the bank for cancellation.
     If damages or incidents not covered by the deposit are detected, the landlord may retain the guarantee as a security measure.

  • Mandatory maintenance:
    It is the tenant's responsibility to carry out regular maintenance of the air conditioning units and boiler. It is also recommended to take out a liability insurance policy, although it is not mandatory.

  • Handling of incidents before departure:
    Any damage or issue should be reported as soon as possible. If you cannot be present at the property, you must provide access to the landlord or the person in charge of managing the repair.
